General Terms of Use

These are the Terms and Conditions that regulate the contractual relationship for the acquisition of products offered by originalpaella.es in its online store.

The Terms and Conditions of sale described below exclusively govern the contractual relations between any user of the originalpaella website pages (hereinafter referred to as the "Customer") and the seller, hereinafter referred to as "originalpaella" and "We", owner of the online store.

1. PURPOSE

1.1. The purpose of these Terms and Conditions of purchase is the supply by originalpaella of the products and services offered in its Online Store, in exchange for financial compensation.

1.2. By accessing our portal, the Customer agrees to comply with these Terms and Conditions as well as the rules of use contained therein.

2. ENTRY INTO FORCE

2.1. These Terms and Conditions, together with your order confirmation, constitute the contract between originalpaella and the Customer for the supply of products. No other Terms and Conditions shall apply.

2.2. The Customer will be deemed to agree with the general conditions provided in this text from the moment they accept that they have read and agree with these Terms and Conditions.

3. PLACING AN ORDER

3.1. To place an order, the Customer must be at least 18 years old.

3.2. The Customer must complete the personal data form available in our Online Store (available 24 hours a day, every day), once they access the page when completing the order and/or registering as a user.

3.3. When the Customer places an order, we will send an order number.

3.4. Although we will make every effort to supply the products listed in your order confirmation, there may be occasions when it is impossible to supply certain products, for example if they are not in stock. In such cases we will contact the Customer to inform them and may suggest alternative products. If the Customer does not accept our suggestions, we will cancel the order for the unavailable products and refund any amount paid for them. This refund will be the limit of our liability to the Customer if we are unable to supply the requested products.

Occasionally, product prices displayed in our Online Store may be incorrectly specified and show a lower price than the correct one. If this occurs and the order has already been confirmed, we will immediately contact the Customer to issue a new order confirmation with the correct price. If the correct price is significantly higher, the Customer may cancel the order and we will refund any amount already paid.

3.5. Exceptionally, it is possible that some products are not in stock, which could increase the delivery time. However, we will always inform the Customer of these circumstances by email. Some products are made to order (large paella pans, natural gas burners and special international connections), in which case the product page will indicate the feature "made-to-order product" and/or the estimated availability time, to which the delivery time according to destination must be added.

3.6. You may cancel your order without any additional cost as long as the shipment has not yet been dispatched.

4. SUPPLY OF YOUR PRODUCTS

We will supply the products indicated in your order confirmation in accordance with these Terms and Conditions.

5. PRODUCT INFORMATION

5.1. We pay great attention to the information relating to the essential characteristics of products through technical descriptions provided by partner companies and manufacturers, and photographs illustrating the products. All of this is done within technical limits and respecting the best market standards.

5.2. Please read product descriptions carefully before purchasing. Images shown may differ slightly from the final product. If in doubt, contact us before making the purchase.

6. PRICES

6.1. The price of each product will be clearly indicated on the website. Prices and conditions of products may vary, but the price and conditions valid for the Customer will always be those in force at the time the order was placed.

6.2. We reserve the right to charge the order from the moment it is received.

6.3. The sales prices indicated in our Online Store are displayed as follows:

If the Customer lives in the European Union, all prices include VAT, but this amount will be deducted from the total if the shipment is made to VAT-exempt areas. The Customer only needs to indicate it in the comments field.

6.4. Shipping service costs are not included in product prices. Shipping costs are borne by the Customer and will be added to the total amount of the selected products. These costs will be shown in the tables in the “shipping and returns” section and confirmed according to weight before completing the order.

6.5. We reserve the right to modify our prices at any time. We try to ensure that all product information is accurate; however, in exceptional cases an incorrect price may appear. If the real price is lower, we will refund the difference. If it is higher, we will cancel the order and notify the Customer by email.

6.6. If the products are delivered outside the European Union, the total price indicated in the order does not include possible indirect taxes, customs duties and/or tariffs applicable according to the destination country. The Consumer agrees to pay them if applicable.

7. AVAILABILITY

Orders will be shipped within the limits of available stock. If an item ordered is not available, we will inform the Customer by email as soon as possible and indicate the estimated delivery time.

8. PAYMENT FOR PRODUCTS

8.1. Originalpaella has partnered with BBVA Bank to guarantee maximum payment security. When the Customer sees the Deutsche Bank symbol, they can consider their transaction fully protected.

8.2. If Originalpaella suspects any anomaly or fraud, it reserves the right to cancel the transaction for security reasons.

8.3. Originalpaella offers the Customer five payment methods:

- Credit/debit card payment

- Bank transfer

- PayPal

- Bizum

- SeQura

All payments are processed securely according to current European security standards.

9. DELIVERY OF PRODUCTS

Products will be delivered to the address indicated by the Customer in the order form.

Delivery times are calculated in working days excluding weekends and holidays.

10. PRODUCT WARRANTY

All products offered by originalpaella are guaranteed for 2 years against manufacturing defects from the date of delivery.

11. THE RIGHT TO RETURN AND EXCHANGE PRODUCTS

11.1. Use of the product and limitations on the right of withdrawal

The customer has a period of 14 calendar days from receipt of the order to exercise their right of withdrawal, in accordance with the applicable regulations.

However, in order for this right to be exercised correctly, the product must be in the same condition in which it was delivered, keeping its original packaging and without having been used beyond what is necessary to check its nature, characteristics and functioning.

In this regard, the following, among others, shall be considered improper use:

• Prolonged use of the product.
• Use at temperatures or under conditions that are not recommended.
• Exposure of the product to heat sources without adequate contents (for example, heating it empty).
• Any handling that causes deformation, structural damage or alterations to its functioning.

In particular, in products such as steel paella pans, overheating or incorrect use may cause deformation (warping), which constitutes use that does not comply with the product instructions for use.

In accordance with the applicable regulations, the customer shall be liable for any loss in value of the product where this results from handling other than that necessary to check its functioning.

Consequently:

• If the product shows signs of improper use or damage resulting from incorrect use, Original Paella reserves the right to reject the return or, where appropriate, apply a deduction to the amount to be refunded in proportion to the loss in value of the product.
• Returns will not be accepted for products that cannot be reconditioned for resale due to incorrect use.

The amount will be refunded using the same payment method used to place the order, within a maximum period of 15 days.

The return of the order, as well as the costs generated by the return, shall be the responsibility of the Customer.

In the case of special products that operate and/or are manufactured to order (large paella pans, industrial burners, etc.), returns will not be accepted, unless the product has a manufacturing defect.

13. OBLIGATIONS OF ORIGINALPAELLA AND THE CUSTOMER

The Customer agrees to provide accurate data in order forms and pay the product price, taxes and shipping costs.

14. PERSONAL DATA PROTECTION

Personal data provided by the Customer are necessary for processing orders and issuing invoices.

15. INTELLECTUAL PROPERTY

All content on the originalpaella online store (illustrations, texts, trademarks, images, videos) is the property of originalpaella.

16. PROMOTIONS AND COUPONS

Promotions and coupons are valid for one month unless otherwise specified.

Only one coupon may be used per purchase.

17. APPLICABLE LAW

These General Terms and Conditions of Sale are governed by Spanish law.

In the event of dispute, both parties submit to the Courts and Tribunals of Valencia (Spain).
